These Terms and Conditions govern the access and use of our website, software, products, and services.
1.0 Introduction
Seedkind.my is a donation-based crowdfunding platform established as a vessel for kindness, with an emphasis on transparency, accountability, and meaningful impact. The platform is specifically designed to support registered organizations and societies, including Non-Profit Organizations (NPO), associations, and charitable bodies, in conducting fundraising campaigns for charitable and community purposes.
Our mission is to facilitate organized and high-integrity charitable actions to create positive change in society while ensuring every donation is channeled to its intended purpose. Through this platform, organizations and societies can raise funds to help those in need, including victims of natural disasters, individuals facing health challenges, underprivileged groups, orphans, and students.
Through these Terms of Service, Seedkind.my affirms our commitment to protecting user data, maintaining public trust, and operating with full integrity to create a crowdfunding environment that is safe, transparent, and efficient.
2.0 Donors
Seedkind.my values and respects the privacy of every donor. This policy explains how donor personal data is collected, processed, stored, and used in accordance with the law and relevant best practices.
2.1 Donor Responsibilities
- Donors are responsible for verifying the authenticity, registration status, and purpose of the campaign organized by the organization or society before making a donation.
- All donations are voluntary and, in general, cannot be refunded once the funds have been channeled to the organizing organization or society.
2.2 Refund Policy
Seedkind.my may process a refund to a donor only under specific circumstances, subject to an official request submitted by the campaign organizer (organization or society).
Note:
Refunds will be processed online after Seedkind.my receives and verifies sufficient evidence to support the request. Refunds can only be made if the funds have not yet been channeled to the organizing organization or society. Once funds are transferred, Seedkind.my is no longer responsible for or capable of facilitating any refund to the donor.
3.0 Campaign Organizers
3.1 Eligibility Criteria
- Campaign organizers must be legally registered organizations or societies, such as Non-Governmental Organizations (NGOs), associations, or charitable bodies, and are required to submit valid verification documents.
- Private individuals are not permitted to organize campaigns on the Seedkind.my platform.
- All information, content, and representations of the campaign submitted must be accurate, transparent, and honest, and must not mislead any party.
3.2 Platform Fees
Seedkind.my charges a platform management fee of 6% of the total funds successfully collected. This fee is used for operations, maintenance, and continuous improvement of the platform.
3.3 Reporting Obligations
- Organizing organizations or societies are required to submit detailed fund utilization reports, including supporting documents such as receipts, photos, and project implementation updates.
- These reports must be submitted before any subsequent withdrawal or release of funds to ensure compliance, transparency, and accountability.
3.4 Disbursement Policy
All collected funds are kept and managed by Rakyat Trustee Berhad as the trustee. Fund disbursements are carried out in stages, beginning with a request from the NGO and subject to a review and approval process by Seedkind.
Once approval is granted, Rakyat Trustee Berhad will process the disbursement according to the agreed project implementation phases, based on progress reports and compliance with set conditions.
NGOs are required to submit a final project report after implementation is completed to ensure transparent and responsible use of funds in line with the funding objectives.
Disbursements are subject to the following terms:
- Seed fund: First disbursement of 25%
- Progress Fund: Second disbursement of 45%
- Completion Fund: Third disbursement of 30%
3.5 Prohibited Activities
Campaign organizers are prohibited from doing the following:
- Using personal accounts for the purpose of fund collection or receipt.
- Receiving donations or payments outside of the official payment gateway provided by the Seedkind platform.
- Misusing collected funds or failing to comply with the platform's Terms and Conditions.
All campaigns registered on the Seedkind platform must comply with the established Shariah compliance guidelines.
4.0 Platform Responsibilities
4.1 Transparency
Seedkind provides tools and features to support transparency, including detailed donation records, final project reports, and campaign updates that are accessible to the public.
4.2 Security
Seedkind implements reasonable technical and operational security measures to protect user data and payment transactions, to ensure the safety and integrity of the platform.
4.3 Disclaimer
- Seedkind does not guarantee the success of any campaign registered on the platform.
- Seedkind is not responsible for any disputes between donors and campaign organizers after a donation payment has been made.
5.0 User Conduct
Users are required to act in good faith, ensure all information submitted to the platform is accurate and not misleading, and comply with all applicable local laws and regulations.
6.0 Dispute Resolution
Should any dispute arise regarding the use of the platform, the user agrees to resolve the dispute through a binding arbitration process and hereby waives the right to participate in or initiate a class action lawsuit.
7.0 Dispute Resolution
Seedkind reserves the right to change, amend, or update these Terms of Service from time to time to reflect operational changes, legal requirements, or prevailing regulations.
Notifications will be provided if there are material or significant changes.
